AVMSD and Online Regulation Briefing

Newspapers seeking to avoid Ofcom regulation of their online audiovisual content ,including short clips, should now consider the European Court of Justice’s recent  preliminary ruling, in addition to past Ofcom dcisions on the application of the ‘video on demand regulatory regime.

Embedding audiovisual material with the online text of the relevant articles, including many and close links to the relevant articles in the online edition, ensuring material is viewed in conjunction with the relevant  articles, rather than accessed and independently viewed could all be helpful.

The directive itself is under review and the Court’s decision may shape views on future revision. The NMA has published a briefing note on the recent European preliminary ruling.
